Terms of Service

1. Acceptance of Terms

By accessing or using MasomoCare ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users including parents, students, tutors, and administrators.

2. Description of Service

MasomoCare is an online marketplace connecting parents and independent students (18+) with verified tutors for one-on-one tutoring sessions. Sessions may be delivered online (via video call) or at the student's home. MasomoCare does not employ tutors directly; tutors are independent service providers.

3. User Accounts

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Users must be at least 18 years old to create an account. Parents may manage accounts for their minor children (under 18). Independent students must complete identity verification (KYC) before booking lessons.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or harmful behaviour.

4. Tutor Verification

All tutors must complete our verification process, which includes submitting a valid National ID, academic certificates, and a police clearance certificate. Verification does not constitute an employment relationship or endorsement. Parents should exercise their own judgement when selecting a tutor.

5. Payments & Escrow

Payments for tutoring sessions are processed through our secure payment system and held in escrow until the lesson is completed. A platform commission (currently 15%) is deducted from each transaction.

Funds are released to the tutor after lesson completion and a 48-hour dispute grace period. If a dispute is raised within this window, funds remain held until resolution.

All prices are displayed in Kenyan Shillings (KES). Tutors set their own rates.

6. Cancellations

Cancellation policies vary by tutor and are displayed on their service listings. Generally, cancellations made more than 24 hours before a scheduled lesson qualify for a full refund. Late cancellations may incur a fee as specified in the tutor's policy.

7. Dispute Resolution

If you are unsatisfied with a lesson, you may raise a dispute within 48 hours of the scheduled end time. Our Trust & Safety team will review the case and may request evidence from both parties. Resolutions may include full or partial refunds, warnings, or account actions.

8. Prohibited Conduct

Users may not:

  • Arrange payments outside the Platform to avoid fees
  • Provide false information during registration or verification
  • Harass, threaten, or abuse other users
  • Use the Platform for any illegal purpose
  • Attempt to circumvent security measures
  • Create multiple accounts to manipulate reviews or ratings

9. Intellectual Property

All content on the Platform (logos, text, design, code) is owned by MasomoCare or its licensors. Lesson materials created by tutors remain their intellectual property unless otherwise agreed.

10. Limitation of Liability

MasomoCare acts as a marketplace and is not liable for the quality of tutoring services provided. We do not guarantee specific academic outcomes. Our liability is limited to the amount of fees paid to us in the 12 months preceding any claim.

11. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Platform after changes constitutes acceptance.
